Abstract:
Medical professionalism is built upon trust, competence, and ethical conduct. Yet cases of doctor misconduct, ranging from clinical errors to boundary violations, continue to challenge healthcare systems worldwide. This seminar examines common forms of medical misconduct and explores how such cases are understood, assessed, and adjudicated within both medical and legal frameworks. Bringing together perspectives from clinical practice, medical ethics, and law, the seminar will unpack key categories of professional wrongdoing. Through real‑world case examples and interdisciplinary analysis, this session will highlight the consequences of misconduct for patients, healthcare institutions, and practitioners, and will also discuss preventive strategies, including improved communication, reflective practice, and institutional safeguards.

Speakers’ Bio:
Dr David Kan
David is a dual qualified medical doctor/solicitor and is a Founding Member of the Faculty of Forensic and Legal Medicine of the Royal College of Physicians (UK). He “changed horses” to law almost 30 years ago and has specialised in healthcare law since.
Nowadays David and Chris Howse lead a team of healthcare lawyers, which is the largest team of its kind in HK, with extensive experience in defending clinical negligence claims.
As an experienced litigator, David has gained accreditation as a Solicitor Advocate with Higher Rights of Audience in Hong Kong’s Court of First Instance, Court of Appeal and CFA. David has substantial advocacy experience before the Civil Courts, Coroner’s Court, Medical and Dental Council and other professional tribunals. He appreciates the importance of getting involved in a case and managing the evidence and strategies from day 1.
David has a Master’s Degree in Medical Law and Ethics which puts him on good stead in providing regulatory advice to healthcare institutions including hospitals, biotechnology companies, medical device manufacturers and specialist group practices. He has a special interest in advising on mental health law, medical criminal proceedings, clinical trials, and due diligence in corporate transactions.
In 2008, David was appointed as an Honorary Associate Professor by the Department of Pathology, HKUMed. He regularly lectures at the University as well as to the Specialist Colleges. He provides clients with training in clinical risk management.
David keeps up to date with clinical medicine, especially in general surgery. He has served on various governing boards including those of a government hospital and a major international school. He is a qualified coach with the Squash Rackets Association (UK) and he trains almost daily.
Dr Robert Law
Dr Robert C L Law has been practising as a specialist in Obstetrics and Gynaecology for over 40 years, and he was elected to be an Honorary Fellow of the HK College of Obstetricians and Gynaecologists in 2023. During his career, he has been extensively involved with the handling of medical complaints. He was Chairman of the PIC of the Medical Council for 10 years and a Panel Chairman for the Public Complaint Committee of Hospital Authority, also for 10 years. He was lecturer at the CUHK Master Course in Complaint Management in Healthcare for the year 2024-2025. He is also an Accredited General Mediator and Accredited Family Mediator. For the last 3 decades, he has written over 150 expert witness reports for the disciplinary proceedings of the Medical Council, Coroner’s Court, and Civil Court in Hong Kong.
